GENERAL TERMS AND CONDITIONS OF SALE OF WHATEVR FANZINE PRODUCTIONS
Sales to individuals
Article 1 – DEFINITIONS
WHATEVR FANZINE PRODUCTIONS: Refers to the company “WHATEVR FANZINE PRODUCTIONS”, a simplified joint-stock company with a capital of 100 €, headquartered at 4 RUE LAKANAL, 93500 PANTIN, registered in the BOBIGNY Trade and Companies Register under number 842 579 252.
Buyer: Refers to the consumer customer contracting with WHATEVR FANZINE PRODUCTIONS.
Article 2 – ENTIRETY
These general conditions express the full obligations of the parties. The buyer is deemed to accept them without reservation. They prevail over any other version or contradictory document and are accessible on the website [URL of the site].
Article 3 – CONTENT
These conditions govern the online sale of products offered by WHATEVR FANZINE PRODUCTIONS to the buyer, from the website [URL of the site].
Article 4 – PRECONTRACTUAL INFORMATION
The buyer acknowledges having been informed, prior to placing the order and concluding the contract, of these general terms and conditions of sale and all the information listed in Article L. 221-5 of the Consumer Code.
Article 5 – THE ORDER
The buyer has the option of placing an order online, from the online catalog and using the form therein, for any product, within the limits of available stocks. The sale will be considered final after sending to the buyer the confirmation of the acceptance of the order by WHATEVR FANZINE PRODUCTIONS by email and after WHATEVR FANZINE PRODUCTIONS has received the full price.
Article 6 – ELECTRONIC SIGNATURE
The online provision of the buyer’s credit card number and the final validation of the order will constitute proof of the buyer’s agreement.
Article 7 – ORDER CONFIRMATION
WHATEVR FANZINE PRODUCTIONS provides the buyer with an order confirmation, confirming the express commitment of the parties.
Article 8 – PROOF OF TRANSACTION
The computerized records, kept in the computer systems of WHATEVR FANZINE PRODUCTIONS under reasonable security conditions, will be considered as proof of communications, orders, and payments between the parties.
Article 9 – INFORMATION ON PRODUCTS
The products governed by these general conditions are those which appear on the website of WHATEVR FANZINE PRODUCTIONS and which are indicated as sold and shipped by WHATEVR FANZINE PRODUCTIONS. They are offered within the limits of available stocks.
Article 10 – PRICE
The prices are in euros or US dollars and are those in effect at the time of the buyer’s order placement. Prices do not include delivery charges, which are charged additionally, and indicated before the validation of the order.
Article 11 – PAYMENT METHOD
This is an order with an obligation to pay, meaning that placing the order implies payment by the buyer. The buyer has, at their choice, all the payment methods made available by WHATEVR FANZINE PRODUCTIONS.
Article 12 – PRODUCT AVAILABILITY – REFUND – RESOLUTION
In the event of unavailability of a product ordered, the buyer will be informed by email. The order for this product will be canceled and refunded, the rest of the order remaining firm and definitive.
Article 13 – DELIVERY TERMS
Products are delivered to the address indicated by the buyer on the order form. Delivery is carried out by Colissimo and can be done internationally.
Article 14 – DELIVERY ERRORS
In case of delivery error or exchange, any product for exchange or refund must be returned to WHATEVR FANZINE PRODUCTIONS in its entirety and in its original packaging.
Article 15 – TRANSFER OF RISKS
The risks of loss or damage to the products are transferred to the buyer upon physical possession of the products.
Article 16 – LIABILITY
The products offered comply with current French legislation. WHATEVR FANZINE PRODUCTIONS cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered.
Article 17 – LEGAL WARRANTY OF CONFORMITY AND WARRANTY FOR HIDDEN DEFECTS
WHATEVR FANZINE PRODUCTIONS is liable for hidden defects in the sold item.
Article 18 – RIGHT OF WITHDRAWAL
The buyer has a period of 14 working days from the date of delivery of their order to return any item that does not suit them and request an exchange or refund without penalty, except for the return costs which remain the responsibility of the buyer.
Article 19 – FORCE MAJEURE
All circumstances independent of the will of the parties preventing the execution under normal conditions of their obligations are considered as causes for exemption from the obligations of the parties and lead to their suspension.
Article 20 – INTELLECTUAL PROPERTY
The content of the magazines and other creative products of WHATEVR FANZINE PRODUCTIONS is protected by copyright and cannot be used for commercial purposes without prior authorization.
Article 21 – PERSONAL DATA
WHATEVR FANZINE PRODUCTIONS commits to protecting the personal data of customers in accordance with the General Data Protection Regulation (GDPR).
Article 22 – PARTIAL NON-VALIDATION
If one or more stipulations of these general conditions are held to be invalid or declared as such under a law, the other stipulations will retain all their force and scope.
Article 23 – NON-WAIVER
The fact for one of the parties not to take advantage of a breach by the other party of any of the obligations referred to in these general conditions cannot be interpreted for the future as a waiver of the obligation in question.
Article 24 – TITLE
In case of difficulty in interpretation between any of the titles at the head of the clauses and any of the clauses, the titles will be declared nonexistent.
Article 25 – CONTRACT LANGUAGE
These general terms and conditions of sale are written in the French language.
Article 26 – MEDIATION
In the event of a dispute, the buyer may resort to conventional mediation or any other alternative dispute resolution method.
Article 27 – APPLICABLE LAW
These general conditions are subject to the application of French law.
